He believes that Kalshi \u201cthreatens the very foundations of tribal gaming.\u201d (Image: IGA\/The Org)<\/figcaption><\/figure>\n<p>Victor Rocha, conference chair of the Indian Gaming Association (IGA) and a member of the Pechanga Band of Indians, told <em>Sportico<\/em> this week that recent conversations with Kalshi executives were unproductive, despite the company\u2019s recent claim to the contrary.<\/p>\n<p>Kalshi offers sports prediction markets via events contracts, a type of derivative that allows users to speculate on the outcome of a specific event. The company argues its platform is legal and distinct from traditional sports betting, a stance that has prompted legal challenges and a backlash from state and tribal officials.<\/p>\n<h2><strong>Opposed by 60 Tribes<\/strong><\/h2>\n<p>More than 60 tribal governments and organizations, including the IGA and the California Nations Indian Gaming Association (CNIGA), have filed an amicus brief in a federal appeals court supporting <a href=\"https:\/\/www.casino.org\/news\/casino-association-of-new-jersey-joins-fight-against-kalshi\/\">New Jersey\u2019s legal battle<\/a> against the prediction platform.<\/p>\n<p>That case hinges on whether the federal Commodity Exchange Act (CEA), which governs events contracts regulated by the Commodity Futures Trading Commission (CFTC), can preempt state-level sports betting laws.<\/p>\n<p>A Kalshi spokesperson recently said the company had \u201cproductive conversations with several tribes\u201d and respected their \u201cinherent sovereignty.\u201d But Rocha told <em>Sportico<\/em> he disputed that characterization, and he didn\u2019t hold back.<\/p>\n<blockquote class=\"main-blockquote\">\n<p>I\u2019ve talked to [Kalshi CEO] Tarek Mansour twice now, and my take from him is that he\u2019s a lying little twerp,\u201d Rocha said.<\/p>\n<\/blockquote>\n<p>Tribal groups argue that allowing Kalshi to bypass state gambling laws through CEA protections would cause broad harm \u2013 not just to New Jersey, but to tribes across the country who operate gaming under the federal Indian Gaming Regulatory Act (IGRA).<\/p>\n<p>\u201cThe idea that Kalshi can do an end-run around tribal-state compacts threatens the very foundation of tribal gaming,\u201d Rocha said.<\/p>\n<h2><strong>Direct Action<\/strong><\/h2>\n<p>While the amicus brief addresses the broader implications of federal preemption, tribal leaders say they are also weighing direct legal action against Kalshi.<\/p>\n<div class=\"callout\">\n<p>In the lead-up to the last presidential election, Kalshi was <a href=\"https:\/\/www.casino.org\/news\/kalshi-transformed-itself-into-online-casino-before-election-regulator\/\">sued by its regulator<\/a>, the CFTC, which argued that the company\u2019s event contracts on the outcome of the vote amounted to illegal political gambling.<\/p>\n<\/div>\n<p>Under the current administration, however, the regulator\u2019s stance appears to have softened, as has the administration\u2019s broader approach toward Kalshi.
